Fatal Hit and Run on Christmas Eve
A man has been killed after a hit and run accident in southwest Miami-Dade on Christmas Eve.
Authorities have identified the victim as Steven Lester, 52. Lester was struck and killed by a Mercedes Benz driven by Adrian Rodriguez in the area of SW 218th Street and 112th Avenue in Miami was struck and killed in the area of SW 218th Street and 112th Avenue.
Eyewitnesses to the fatal accident say that Rodriguez stopped briefly but attempted to flee the scene. He was prevented by witness and Good Samaritan, Octavius Hamilton and another motorist, Arturo Falconer.
“I ran the Mercedes down, cut him off and I asked him to turn the car off,” said Falconer. “I asked him to get out of the car, sit in the back of the car, and wait for the officers to come.”
Falconer and Hamilton took the keys to Rodriguez’ car away from him until police could arrive at the scene.
Florida Highway Patrol trooper, Indiana Villalonga said that Hamilton and Falconer shunned praise for doing what they knew was right; they did a good thing and put themselves at risk. This is especially true since the two men had no idea whether or not Rodriguez was armed at the time he was apprehended.
Rodriguez was arrested and charged with leaving the scene of an accident involving a death. So far investigators have said that there is no evidence that suggests that Rodriguez was driving under the influence of alcohol or drugs at the time and that Lester may have been at fault because he crossed in the middle of the block in the dark.
The real problem comes, however, because Rodriguez left the scene of a fatal accident. The penalties for leaving the scene of an accident in the State of Florida are also very serious. According to Florida Statute 316.027, if someone is involved in a crash involving serious personal injuries or fatalities, they must immediately stop the vehicle at the scene of the crash, or as close as possible. If they are involved in such an accident, then they are required to remain at the scene of the crash until they are released by a law enforcement officer.
Never be tempted to leave the scene of an accident and never sign any statement or settlement with an insurance company until you have competent legal representation in your corner.
