Cyclist Killed at Pompano Beach

indexA bicyclist has been killed after he was struck by a vehicle while he was in the middle of a Pompano Beach intersection on Thursday night.

According to authorities, the accident happened at North Federal Highway and N.E. when Douglas Pellicane, 57, was riding his bicycle eastbound, just north of the crosswalk. Pellicane failed to stop at the red light and went through the intersection.

Pellicane was struck by 2005 Nissan Altima, driven by Paul Mills, 27, heading northbound. Mills remained at the scene of the accident and cooperated fully with investigators.

Emergency crews with Pompano Beach Fire Rescue transported Pellicane to Broward Health North where he later died as a result of the injuries sustained in the accident.

The investigation of the accident is currently ongoing. No charges have been filed so far.

A bicyclist’s main concern when they are on the road is being struck and injured by a motorist.

In this case, if it does turn out that the party who is at fault is the driver, the cyclist or his family has a legal right to be compensated. Even if no criminal charges are filed, there could possibly be a civil suit filed on the part of the family for wrongful death of their loved one.

By law, even if there is no charge of negligence or the driver is deemed to be not at fault in an accident involving a cyclist, that cyclist or surviving family can bring a lawsuit.

Following the rules of the road applies to everyone, whether they are in a motor vehicle, on a bicycle or even on foot.
